By creating an account, placing an order, or otherwise using the Services, you agree to be bound by these Terms. If you do not agree, you may not use the Services.

1) Eligibility

  • You may need an account to place orders. You must provide accurate, complete, and current information.
  • You are responsible for maintaining the confidentiality of your login credentials and all activities that occur under your account.
  • Notify us immediately if you suspect unauthorized use of your account.

3) Orders & fulfillment

When you place an order through our Services:

  • Restaurant responsibility: Each restaurant is solely responsible for preparing and fulfilling your order, including food safety and quality.
  • Delivery: Delivery may be handled by the restaurant, third-party couriers, or other partners. Delivery times are estimates and not guaranteed.
  • Allergies & dietary needs: You are responsible for communicating allergies or dietary restrictions directly to the restaurant. We do not guarantee allergen-free food.

4) Payments & pricing

  • Prices, fees, and taxes are shown at checkout. Prices may vary from in-restaurant pricing.
  • Payments are processed by third-party providers. By submitting payment details, you authorize the charge for the full order total.
  • We are not responsible for errors or unauthorized transactions caused by payment providers.

5) Cancellations & refunds

  • Orders cannot be cancelled once accepted by the restaurant, unless the restaurant agrees.
  • Refunds may be issued at the restaurant’s discretion or if an order cannot be fulfilled.
  • Delivery fees and service charges are typically non-refundable unless required by law.

6) Acceptable use & conduct

You agree not to:

  • Use the Services for unlawful, fraudulent, or abusive purposes.
  • Interfere with the operation of the Services (e.g., hacking, introducing malware).
  • Impersonate another person or misrepresent your affiliation.
  • Harass or harm restaurant staff, couriers, or other users.

7) Intellectual property

All content, logos, trademarks, and software provided through the Services are owned or licensed by NextWave Online or its partners. You may not copy, modify, distribute, or reverse engineer any part of the Services without our prior written permission.

8) Disclaimers

The Services are provided “as is” and “as available.” We make no warranties, express or implied, regarding availability, reliability, accuracy, or quality. Restaurants are solely responsible for their food and services.

9) Limitation of liability

To the maximum extent permitted by law, NextWave Online and its affiliates are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits, revenues, or data, arising from or related to your use of the Services.

10) Indemnification

You agree to defend, indemnify, and hold harmless NextWave Online, its affiliates, and partners from any claims, damages, liabilities, and expenses (including legal fees) arising from your use of the Services, your violation of these Terms, or your violation of any rights of a third party.

11) Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for conduct that we believe violates these Terms, applicable laws, or is otherwise harmful to us, our partners, or other users.

12) Governing law & disputes

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes will be resolved exclusively in the courts of Calgary, Alberta, Canada.

13) Changes to terms

We may update these Terms from time to time. Changes will be effective when posted on this page, with the “Effective date” updated. Continued use of the Services after changes constitutes acceptance of the updated Terms.
